In my earlier posts I have referred to PM Manmohan Singh's remarks about the Supreme Court or other courts not to indulge in policy matters of the State as if administration of justice was not included in the State Policy even though the Indian Constitution places Justice before all other parameters . Now with the cat out of the bag in the Raja Spectrum affair under the very nose of Mr.Manmohan Singh does the Honb'le PM still feel that justice is not included in the State Policy?
Indian Prime Minister's recent remarks about Supreme Court not to indulge in State Policy Matters is disturbing as it infringes upon the very basic principles of the Indian Constitution which incorporates the following annunciation in its very preamble:
" We the people of India,having solemnly resolved to constitute India into a sovereign socialist democratic republic and to secure to its citizens:
Justice,social,economic and political; Liberty of thought,expression,belief,faith and worship; Equality of status and opportunity; and to promote among them all Fraternity assuring the dignity of the individual and the unity and integrity of the Nation; In our Constituent Assembly this twenty-sixth day of November,1949, do hereby adopt,enact and give to our-selves this Constitution."
As is evident from the above Justice is the first State Policy of our Nation and all other parameters follow it.
The Supreme Court is duty bound to implement and enforce the first State Policy of Justice and the Executive is bound to follow it.
